Welcome to Wells Travels. By accessing or using our website, mobile site, or related services (together, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Services.

1. About Us and Our Role
Wells Travels provides a platform to search, compare, and book travel products and services such as flights, trains, buses, hotels, transfers, car rentals, attractions, eSIMs, insurance, and related offerings.
In many cases, bookings are provided and fulfilled by third-party suppliers (airlines, hotels, OTAs, insurers, telecom providers, tour operators, etc.). We may act as an agent, facilitator, or affiliate. Your contract for a booked product or service may be with the relevant supplier, and their terms will apply in addition to these Terms.

2. Eligibility
- You must be at least 18 years old and have legal capacity to enter into a contract.
- By using the Services, you represent that all information you provide is accurate and you have authority to make bookings for yourself or on behalf of others.

3. Accounts
- You may be required to create an account. Keep your credentials confidential and notify us of any unauthorized use.
- You are responsible for all activity under your account.

4. Bookings, Payments, and Pricing
- Availability, prices, taxes, fees, baggage rules, change/cancel policies, and other conditions are set by suppliers and may change without notice.
- Payment processing may be handled by us or a secure third-party payment processor. We do not store full card details.
- Currency conversions are approximate and may differ from charges on your statement due to bank exchange rates and fees.
- Before finalizing a booking, review all fare rules, inclusions, exclusions, and supplier terms displayed at checkout.

5. Cancellations, Changes, and Refunds
- Cancellation, change, no-show, and refund policies are determined by the supplier. Some bookings may be non-refundable or non-changeable.
- If allowed, changes or cancellations may incur supplier fees and our administrative fees.
- Refund timelines depend on the supplier and payment processor. We will pass any eligible refund once received from the supplier.

6. User Responsibilities
- Ensure names, travel dates, passport details, contact information, and payment information are correct before booking.
- Obtain visas, travel authorizations, insurance, vaccinations, and meet health and entry requirements for your destination.
- Arrive on time and comply with airline, rail, bus, hotel, and local regulations.
- Do not use the Services for any unlawful purpose or in a manner that could damage or impair the platform.

7. Travel Insurance and Risk
Travel involves inherent risks. We strongly recommend adequate travel insurance covering medical emergencies, trip cancellation/curtailment, baggage loss, and other risks. We are not liable for losses arising from events beyond our control.

8. Third-Party Services and Affiliate Links
Some links on our platform may direct you to third-party websites or services. We do not control and are not responsible for their content, policies, or performance.
We may receive commissions or other benefits when you purchase through affiliate links, without additional cost to you.

9. Content and Reviews
You may submit reviews, photos, or other content where enabled. You grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with the Services.
You must own or have rights to the content you submit and it must not be unlawful, misleading, or infringe any rights. We may moderate or remove content at our discretion.

10. Intellectual Property
All trademarks, logos, text, graphics, and other materials on the Services are the property of Wells Travels or its licensors. You may not copy, modify, distribute, or create derivative works without prior written permission.

11. Privacy and Cookies
Your use of the Services is subject to our Privacy Policy and Cookie Notice, which describe how we collect, use, and share information, and your choices. By using the Services, you consent to such processing.

12. Prohibited Activities
- Automated scraping, data mining, or use of bots without permission.
- False bookings, speculative bookings, or bookings in anticipation of demand.
- Circumventing security features or interfering with platform functionality.

13. Disclaimers
The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, to the fullest extent permitted by law.
We do not guarantee uninterrupted or error-free operation, or that defects will be corrected.
Descriptions, ratings, schedules, and images are provided by suppliers or third parties and are for general information; we are not responsible for inaccuracies.

14. Liability Limitation
To the maximum extent permitted by law, Wells Travels is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunity.
Our total aggregate liability arising out of or in connection with the Services shall not exceed the greater of (a) the service fees you paid to us for the booking that gave rise to the claim, or (b) USD 100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnity
You agree to defend, indemnify, and hold harmless Wells Travels and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services or violation of these Terms or third-party rights.

16. Chargebacks and Fraud Prevention
Unauthorized chargebacks or fraudulent activity may result in booking cancellation and account suspension. We reserve the right to provide evidence to payment providers and law enforcement as needed.

17. Force Majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, wars, terrorism, pandemics, government actions, or failures of suppliers.

18. Changes to the Services and Terms
We may modify the Services and update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance of the updated Terms.

19. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, sections intended to survive will remain in effect.

20. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in New Delhi, India, for the resolution of any disputes arising from or relating to these Terms or the Services.
